Official Rules for the Sherwin-Williams Purdy Paint Pros Sweepstakes

No Purchase Necessary. A Purchase Will Not Increase Your Chances Of Winning.

Eligibility: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old. Employees of The Sherwin-Williams Company (“Sponsor”), as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.

Timing:  The Sweepstakes begins at 12:00:00 a.m. ET on Monday, November 12, 2018, and ends at 11:59:00 p.m. ET on Sunday, December 9, 2018 (the “Entry Period”). Sponsor’s computer is the official time-keeping device for the Sweepstakes.

To Enter the Sweepstakes: To enter the Sweepstakes, you must have a Facebook account and be a follower of the SW Paint Pros Facebook Page. A Facebook account is required to enter and can be opened for free by visiting Facebook.com. At the beginning of each week during the Entry Period, SW Paint Pros will post a photo (“Photo”) with a caption that includes the hashtags #PurdyPro and #Sweepstakes. To enter a weekly drawing, you must click on the link to the Purdy Pro Sweepstakes landing page and complete the entry form, providing your name, company name and email address. Entries must be complete to be eligible.

Entry Chart for Weekly Drawings:

Limit one entry per week, per person/household. Multiple Sweepstakes entries from any person/household per post will not be accepted during a single week but you may enter 1 time each week during the Entry Period. Prior entries will not be eligible for any subsequent weekly drawings. No endorsement or approval of Sweepstakes by Facebook are expressed or implied. Entrant posts relating to the Sweepstakes represent solely the views and opinions of the individual entrant and do not reflect the views and opinions of the Sponsor in any manner.

Random Drawings/Winner Notification: One (1) Prize winner will be selected at random for each of the four (4) weekly drawings on or about the dates specified in the chart in Section 3 above from among all eligible entries received during the applicable weekly entry dates. The odds of winning one of the weekly prizes will depend on the number of eligible entries received during the applicable weekly entry period. Limit of one (1) weekly prize per person/household. Potential Prize winners will be contacted via the email address provided within 48 hours following the applicable random drawing. The email will ask the potential winner to confirm their eligibility by responding with their full name, company name and email address and mailing address. Potential winners will have three (3) days to respond with their information or the potential winner will be disqualified. If necessary, if prize notification/documentation is not completed and returned within three (3) days or prize is returned as undeliverable, an alternate potential winner may be randomly selected from among all remaining eligible entries received during the applicable entry dates.  A maximum of three (3) alternate potential winners may be contacted for each random drawing. Prizes are nontransferable and no substitution is allowed except by the Sponsor, who reserves the right to award a prize of equal or greater value if advertised prize is unavailable for any reason. Winner is responsible for all applicable federal, state and local taxes and all other costs and expenses associated with prize not specified herein as being awarded. The winners will be sent their prizes within 6-8 weeks after eligibility verification.

Prizes and Approximate Retail Value (“ARV”):

General Conditions:  In the event that the operation, security, or administration of the Sweepstakes is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes; or (b) award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Sweepstakes, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor shall not be deemed proof of receipt of that communication by Sponsor. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited.

Release and Limitations of Liability:  By entering, you agree to release and hold harmless Sponsor, Facebook, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Privacy:  Any information you submit as part of the Sweepstakes will be treated in accordance with Sponsor’s Privacy Policy.

Disputes:  You agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Cleveland, Ohio. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Ohio, without giving effect to any choice of law or conflict of law rules (whether of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Ohio.

Sweepstakes Results:  For winners’ names, available after January 1, 2019, send a self-addressed, stamped envelope to Kathy Amend, C/O The Sherwin-Williams Company, 101 West Prospect Avenue, 1060 Guild Hall, Cleveland, Ohio 44115, ATTN: Purdy Paint Pro Sweepstakes. Requests must be received by March 1, 2019.
